1. Agreement to Terms
These Terms of Service (“Terms”) form a binding agreement between you and the operator of Blushly.chat (the “Service,” “we,” “us,” or “Blushly”). By accessing or using the Service—including creating an account, browsing characters, chatting, generating media, or purchasing a plan—you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Service. We may update these Terms from time to time; material changes will be communicated as described in Section 12.
2. Eligibility — Adults Only (18+)
You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) to use the Service. The Service includes mature themes, adult roleplay, and sexually explicit content between adult characters.
By using the Service, you represent and warrant that you meet this age requirement. We may request additional verification or restrict access if we reasonably believe you are underage. False age representations may result in immediate account termination without refund, to the extent permitted by law.
We have zero tolerance for sexual or romantic content involving minors (including fictional depictions), and for underage users. See our Community Guidelines.
3. The Service
Blushly.chat is an online platform for AI-assisted character chat and related features, which may include text messaging, voice output (text-to-speech), voice input (speech-to-text), in-chat image generation, character creation and galleries, favorites, search, published chats, and subscription-based quotas and memory limits. Feature availability depends on your plan, character settings, and technical capacity.
AI responses are generated by third-party and/or platform-hosted models configured for the Service. Model inventory, quality, and behavior may change without notice. Outputs may be inaccurate, offensive, or inconsistent. The Service does not provide medical, legal, financial, therapeutic, or emergency advice.
4. Accounts and Security
You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms, applicable law, or our Community Guidelines, or that pose risk to the Service or other users. We may limit one account per person where needed to prevent abuse.
5. Subscriptions, Tokens, and Payments
Plans and quotas
The Service offers a free tier and paid plans (including Standard, Pro, and Ultimate), as well as token packs where available. Paid plans may unlock higher chat memory, message and voice quotas, image-generation capacity, and other features described on the pricing page at the time of purchase. Plan details may change; the pricing page controls then-current entitlements.
Payment processors
Payments are processed by third-party providers (including, depending on region and method, Patreon, Gank, and crypto checkout via NOWPayments). Those providers' terms and privacy policies also apply. We do not store full payment card numbers. Subscription activation is typically linked to the email associated with your Blushly account; mismatches may delay access until resolved with support.
Billing, renewal, and cancellation
Paid subscriptions may renew automatically for successive periods unless canceled through the applicable payment provider or account controls before the renewal date. Upon cancellation, paid benefits generally continue until the end of the then-current paid period. Price changes will be communicated in advance where required; continued use after the effective date constitutes acceptance where permitted by law.
Refunds
Except where required by applicable law or expressly stated by us or a payment provider, fees are non-refundable, including for unused time, unused quotas, or partial billing periods. Chargebacks or payment disputes initiated in bad faith may result in account suspension. Token or quota refunds for failed image-generation jobs may be issued automatically under our technical policies and do not create a general right to cash refunds.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms and the Community Guidelines. Without limitation, you must not:
Child sexual exploitation
Create, request, upload, or share any sexual or romantic content involving anyone under 18, including fictional or AI-generated depictions. We report illegal material to authorities as required.
Illegal or harmful content
Engage in or solicit illegal activity; non-consensual intimate imagery; extreme violence or real-world threats; hate speech; doxxing; or other content prohibited by our Guidelines.
Platform abuse
Spam, scrape, reverse engineer, bypass rate limits or security, automate accounts without authorization, or disrupt the Service.
Fraud and IP infringement
Payment fraud, unauthorized chargebacks, impersonation, account selling, or uploading content you do not have rights to use.
Violations may result in content removal, suspension, permanent ban, and referral to law enforcement where appropriate.
7. Content and Intellectual Property
Your content
You retain ownership of original content you submit (such as character definitions, messages, and images you upload), subject to the licenses below and third-party rights. You represent that you have all rights necessary to submit that content and that it complies with these Terms.
License to Blushly
You grant Blushly a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and distribute your content as needed to operate, secure, and improve the Service—including displaying public characters and published chats to other users. If we wish to use your content in marketing beyond ordinary platform display, we will seek permission unless already authorized by you.
AI-generated outputs
Subject to these Terms and applicable law, you may use AI-generated outputs from your sessions for personal use. We do not warrant that outputs are unique, non-infringing, or fit for any particular purpose. Providers of underlying models may impose additional restrictions.
Our IP
The Service software, design, trademarks, logos, and branding are owned by Blushly or its licensors. You may not copy, modify, or redistribute them without prior written permission.
Copyright complaints
Copyright infringement notices may be sent to [email protected]. We may remove allegedly infringing material and terminate repeat infringers where appropriate.
8. Privacy
Our collection and use of personal information is described in the Privacy Policy. Chat and media content are stored on our systems to provide history and features. Content may be transmitted to third-party AI and infrastructure providers solely to deliver the Service. The Service does not provide end-to-end encryption between you and another human user for AI chats.
9. Moderation
We may use automated systems, user reports, and human review to enforce these Terms and the Community Guidelines. We do not pre-screen all content. We may remove content, restrict features, or terminate accounts at our discretion when we believe a violation has occurred or when required by law.
10. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted uptime, error-free operation, or that AI outputs will be accurate, appropriate, or available.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUSHLY AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR, IF GREATER, THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
11. Indemnification
You agree to defend, indemnify, and hold harmless Blushly and its operators from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
12. Changes; Contact; Disputes
We may modify the Service or these Terms. For material changes to the Terms, we will provide reasonable notice (for example, via email or in-product notice) where practicable. Continued use after the effective date constitutes acceptance of the updated Terms, except where prohibited by law.
Before filing a formal claim, contact [email protected] so we can attempt to resolve the dispute informally. Nothing in these Terms limits non-waivable consumer rights in your jurisdiction.
